How Berg Safety Management collects, uses, and protects your personal information.

Berg Safety Solutions ("Berg Safety Management," "we," "us," or "our") is committed to protecting the personal information of our clients, their employees, and all individuals whose data is handled through our platform. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information in accordance with Alberta's Personal Information Protection Act (PIPA) and British Columbia's Personal Information Protection Act (BC PIPA).
By accessing or using Berg Safety Management, you agree to the collection and use of information as described in this policy. If you do not agree, please discontinue use of the platform.
Important: Berg Safety Management is a documentation management tool. Client organizations (employers) are responsible for their own legal obligations regarding worker personal information under Alberta OHS, WorkSafeBC, WCB, and applicable privacy legislation.
We collect personal information necessary to provide our safety documentation platform. This includes:
Account & Business Information:
- Company name, business address, and contact details
- Administrator name, email address, and phone number
- Billing information (processed securely through our payment provider)
- Number of workers and project/site details
Worker & Field Documentation Data (entered by client organizations):
- Worker names, signatures, and trade/certification records
- Incident reports, first aid records, and near miss reports
- FLHA, toolbox meeting sign-offs, and orientation records
- Equipment inspection records and permit documentation
- Site photos attached to forms
Usage Data:
- Login timestamps, IP addresses, and device/browser information
- Form submission logs and platform activity records
Note: Worker personal information entered into the platform is done so by the client organization (employer). Employers are responsible for obtaining appropriate consent from workers for data entered on their behalf, in accordance with applicable privacy legislation.
We use collected information solely to:
- Provide, operate, and maintain the Berg Safety Management platform
- Process account registrations and billing
- Generate PDF documentation and store records on behalf of client organizations
- Send account-related notifications, updates, and support communications
- Improve platform features and user experience
- Comply with applicable legal obligations
We do not sell, rent, or trade your personal information or your workers' personal information to any third party for marketing purposes.
All data submitted through Berg Safety Management is stored on secure cloud infrastructure. We implement the following safeguards:
- Encryption in transit: All data transmitted between your device and our servers is encrypted using TLS (HTTPS)
- Encryption at rest: Stored data, including safety records and worker documentation, is encrypted at rest
- Access controls: Role-based access ensures only authorized users within your organization can view your records
- Backups: Regular automated backups protect against data loss
- Audit logs: Platform access and form submissions are logged for security and compliance purposes
Data Location: Client data is stored on servers located in Canada. We do not transfer your data outside of Canada without your consent, except as required by law or to operate with Canadian-based infrastructure providers.
While we implement commercially reasonable security measures, no system is completely immune to security risks. We encourage clients to maintain strong account passwords and report any suspected unauthorized access immediately.
We do not disclose your personal information or your workers' information to third parties except in the following circumstances:
- Service providers: Trusted third-party vendors who assist in operating our platform (e.g., cloud hosting, payment processing), bound by confidentiality obligations
- Legal requirements: When required by law, court order, or government authority, including Alberta OHS enforcement or WorkSafeBC investigations
- Protection of rights: To protect the rights, property, or safety of Berg Safety Solutions, our clients, or others
- Business transfers: In the event of a merger, acquisition, or sale of assets, with appropriate notice to affected parties
- With your consent: For any other purpose with your explicit consent
Berg Safety Management handles sensitive occupational health and safety documentation including incident reports, injury records, and medical aid information. We treat this category of data with heightened care:
- Incident and first aid records are accessible only to authorized personnel within the client organization
- We do not share incident data with Alberta OHS, WCB, or WorkSafeBC — reporting obligations remain the sole responsibility of the employer
- Injury and medical information is stored with the same encryption and access controls applied to all platform data
- Workers whose data is stored in the platform may request access through their employer (the account holder)
Employers using our platform remain the data custodians for their workers' personal information and are responsible for compliance with Alberta PIPA, BC PIPA, and any applicable OHS legislation regarding worker health records.
Under Alberta PIPA and BC PIPA, individuals have the right to:
- Access their personal information held by an organization
- Correct inaccurate or incomplete personal information
- Withdraw consent to the collection, use, or disclosure of their personal information (subject to legal or contractual restrictions)
- Make a complaint to the relevant Privacy Commissioner if they believe their rights have been violated
Account holders (employers) may submit access or correction requests directly through the platform or by contacting us at info@bergsafetysolutions.com.
Workers whose information has been entered by their employer should direct access requests to their employer first, as Berg Safety Solutions acts as a data processor on behalf of the employer organization.
We retain personal information for as long as necessary to provide our services and meet legal obligations:
- Active accounts: All data is retained for the duration of your subscription
- Account cancellation: Data is retained for 90 days after account cancellation to allow for export, then securely deleted upon request or automatically purged
- Safety records: Incident, injury, and regulatory compliance records may be retained longer where required by Alberta OHS, WorkSafeBC, or WCB legislation
- Billing records: Retained for 7 years as required by Canadian tax and financial regulations
Clients may request deletion of their data at any time by contacting us, subject to any retention obligations imposed by law.
Our website uses cookies and similar technologies to:
- Maintain user sessions and authentication
- Remember user preferences
- Analyze website traffic and usage patterns to improve our service
You may disable cookies through your browser settings; however, some platform features may not function correctly without them. We do not use cookies to track users across third-party websites.
Our platform integrates with third-party services necessary for operations. These may include cloud hosting providers, payment processors, and PDF generation services. All third-party service providers are required to handle data in a manner consistent with this Privacy Policy and applicable Canadian privacy law.
Our website may contain links to external resources such as Alberta.ca, WCB Alberta, and WorkSafeBC. We are not responsible for the privacy practices of these external sites.
We may update this Privacy Policy from time to time to reflect changes to our practices, platform features, or legal requirements. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify active account holders by email at least 14 days before changes take effect
- Post a notice in the client portal
Continued use of Berg Safety Management after changes take effect constitutes acceptance of the revised Privacy Policy.
